These Terms and Conditions (“Terms”) govern your use of the website operated by Ragin Wool (“we”, “us”, “our”) at raginwool.eu (“the Website”), as well as all products, services, and content available through the Website. By accessing or using the Website, you agree to be bound by these Terms.
2. Definitions
Website: The online platform operated by Ragin Wool at raginwool.eu
Customer/You: Any person who uses the Website, places an order, or purchases a product from us.
Products: The slow fashion items sold on the Website.
Contract: The binding agreement formed when you place an order that is subsequently accepted and confirmed by us.
3. General Terms
3.1. Eligibility: By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
4. Products and Orders
4.1. Product Descriptions: We pour our hearts into ensuring all product descriptions, images, and prices are as accurate as possible. As our items are handcrafted and a part of the slow fashion movement, minor variations may occur, which is a testament to their unique quality. While we do our absolute best, we can’t guarantee that every single detail will be completely error-free.
4.2. Order Acceptance: Your order constitutes an offer to purchase a product. All orders are subject to our acceptance, which will be confirmed via email. We reserve the right to refuse or cancel an order at any time for reasons including, but not limited to, product availability, errors in the description or price, or suspicion of fraudulent activity.
5. Pricing and Payment
5.1. Prices: All prices are listed in Euros (€) and are inclusive of VAT (value-added tax) as required by Dutch law. Prices do not include shipping costs unless otherwise stated.
5.2. Payment: We accept the following payment methods: iDeal, bank transfer, debit card. Payment will be processed at the time the order is placed.
6. Shipping and Delivery
6.1. Shipping Costs: Shipping costs are calculated at checkout and are the responsibility of the Customer.
6.2. Delivery Times: We aim to ship products within 3 business days of receiving your order. Delivery times are estimates and may be subject to delays beyond our control.
6.3. Pre-Orders: 6.3.1 Placing a Pre-order When placing a Pre-order your contact information must be accurate and kept updated. If we do not have accurate or updated contact information we will not be able to keep you informed of your Pre-order. You can update your contact information at any time prior to your product being shipped by contacting our customer support. Please note that Pre-orders are non-transferable.
6.3.2 Payments When you place a Pre-order you will need to pay the full price for the product(s) ordered and any applicable delivery fees. Please note that as with all orders that are to be shipped to a delivery address outside the EU, Pre-ordered products may be subject to import charges, duties and taxes that you are responsible for paying.
6.3.3 Delivery Pre-ordered products will be shipped as soon as possible, subject to availability. Please note that launch dates and dates of availability of products are subject to change and we are not liable for any changes to such dates.
6.3.4 Cancellation Either party may cancel a Pre-order at any time for any or no reason prior to our notice to you that the Pre-ordered product/s has/have been shipped (“Shipping Notice”). If cancellation occurs before we sent you the Shipping Notice you will be entitled to a full refund of your Pre-order payment. If you would like to cancel the purchase after the Shipping Notice is sent to you the terms regarding withdrawal in the Terms for Purchase shall apply.
6.35 Disclaimer Regarding any Pre-order for a product that is not yet launched you understand and agree that such product’s design and technical features are currently under development and that the product that may be shipped to you may differ from the product displayed at the time of Pre-order. If for any reason you are not happy with the final version of the product, your sole and exclusive remedy will be your right to withdrawal as set out in the Terms for Purchase.
7. Right of Withdrawal (Herroepingsrecht)
7.1. Right to Withdraw: As a Customer in the Netherlands and the wider EU, you have the right to withdraw from this Contract within 14 calendar days without giving any reason. The withdrawal period expires 14 days from the day on which you or a third party, other than the carrier and indicated by you, acquires physical possession of the products.
7.2. Conditions for Withdrawal: To be eligible for a refund, the product must be returned in the same condition as you received it. According to Dutch law (Burgerlijk Wetboek, Book 7, Article 230s), you are permitted to handle and inspect the product as you would in a physical store. However, any handling beyond this necessary inspection may reduce the product’s value, and you may be held liable for this loss.
7.3. How to Withdraw: To exercise your right to withdraw, you must inform us of your decision by an unequivocal statement. Please email us at returns@raginwool.eu with your name, address, order number, and your clear intention to withdraw from the contract.
7.4. Returns: You must return the products to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. You are responsible for the direct cost of returning the products.
7.5. Refunds: We will process your refund, excluding the costs of standard delivery, within 14 days from the day we receive your returned products or receive proof that you have shipped them. The refund will be made using the same payment method used for the initial transaction.
8. Intellectual Property
All content on this Website, including text, graphics, logos, images, and software, is our exclusive property or licensed to us, and is protected by international intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.
9. Liability and Limitation of Liability
We will not be liable for any indirect or consequential loss or damage arising under these Terms. Our total liability to you in respect of any claim will be limited to the value of the product you purchased.
10. Privacy Policy
Our use of your personal data is governed by our separate Privacy Policy. By using the Website, you consent to the processing of your data as described in the Privacy Policy.
11. Disputes and Applicable Law
These Terms are governed by the laws of the Netherlands. Any dispute arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of Rechtbank Noord-Nederland
